Quoteline

Terms of Service

Version 2026-10-25-draft-2

Draft, pending attorney review. This document will change before Quoteline sends any real texts.

These Terms of Service are an agreement between Quoteline LLC, a Michigan limited liability company ("Quoteline", "we"), and the business that creates an account (the "Agency", "you"). By creating an account or using Quoteline, you agree to these Terms, the Acceptable Use Policy, the Privacy Policy and the SMS Terms. The person accepting confirms they're authorized to bind the Agency.

1. What Quoteline is

Quoteline is software that lets an Agency send text messages to its own contacts from the Agency's own verified phone number, and manage the replies. Quoteline doesn't supply, sell, buy, recommend or share leads, and doesn't send messages on its own initiative.

2. The Agency is the sender

For every message sent through your account, you are the sender and the party that "initiates" the message. You alone:

  • choose who receives messages, from contacts you upload or select;
  • write or approve the exact text of every message;
  • choose when each campaign runs, within legal sending windows;
  • launch each campaign yourself, with an explicit confirmation step.

Quoteline staff never launch campaigns or send messages for you. Quoteline may block, pause or delay messages to enforce the law, carrier rules or these Terms, but never starts them.

3. Consent is your responsibility

You are solely responsible for having each recipient's prior express written consent to receive texts from your Agency, where that consent names your Agency, before you message them. You'll keep proof of consent (date, source, the consent wording, and any TrustedForm or Jornaya certificate) and give it to Quoteline within 5 business days of a request. Leads from shared or aged lists without consent that names you may not be uploaded.

4. Following the law and carrier rules

You'll comply with the Telephone Consumer Protection Act, the Telemarketing Sales Rule, National and state Do Not Call rules, state telemarketing and texting laws (including any registration your state requires), and the rules of Twilio and the wireless carriers. You'll honor opt-out requests immediately and permanently. Quoteline's compliance features help, but don't replace your own obligations, and aren't legal advice.

5. Your phone number

Your Agency gets its own Twilio sub-account and toll-free number, verified in your legal business name and registration number. The information you give for verification must be true and complete. You may not rotate numbers or spread traffic across numbers to avoid filtering.

6. Your data

You own the contact data you upload. Quoteline processes it only to provide the service and on your instructions, as described in the Privacy Policy, and never sells it or shares it with other agencies. A separate Data Processing Agreement will be available on request.

7. Indemnity

You will defend, indemnify and hold harmless Quoteline LLC and its members, employees and contractors from any claim, fine, penalty, settlement, cost or attorney's fee arising from messages sent through your account, your contact data or consent records, or your breach of these Terms or of any law.

8. Suspension and termination

Quoteline may suspend your account immediately, without notice, to protect consumers, carriers, Twilio or the platform, including when opt-out or complaint rates are unusually high or when you don't provide consent records on request. You may close your account at any time.

9. Fees

Paid plans, usage limits and billing terms will be shown before you subscribe. Nothing is charged during the test period.

10. Records

Quoteline keeps an audit log of account activity and every send decision for at least 5 years, and you can export it. Quoteline may use these records to respond to legal process or defend claims.

11. Disclaimers and limit of liability

Quoteline is provided "as is". To the extent the law allows, Quoteline isn't liable for indirect, incidental or consequential damages, and its total liability for any claim is limited to the fees you paid Quoteline in the 12 months before the claim.

12. Changes

We may update these Terms. When we do, you'll be asked to accept the new version before you keep using Quoteline.

13. Governing law

These Terms are governed by the laws of the State of Michigan.
